1. Introduction

Welcome to Monaleah (accessible at monaleah.com). By accessing our website and purchasing our personalized memorial products, you agree to be bound by the following Terms of Service.

These Terms apply to all users of the site, including browsers, vendors, customers, merchants, and contributors of content. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any servicess

2. Personalization and Accuracy

 This is the most critical section regarding your custom order. Please review carefully:

  • Customer Responsibility: You are strictly responsible for ensuring the accuracy of all details provided for personalization. This includes, but is not limited to:

    • Spelling of names.

    • Accuracy of dates (birth and passing).

    • Selection of specific designs, fonts, or motifs.

  • No Proofing Provided: Unless explicitly stated on a specific product page, Monaleah does not provide digital proofs before production. We will customize or print the information exactly as it is entered at checkout.

  • Correction Requests: If you notice an error in your order, you must contact us immediately (within 1 hour of placement). Once an item has entered the engraving or production phase, changes cannot be made.

3. Product Nature and Variations

Natural Materials: Many of our products, specifically garden stones and slate markers, are crafted from natural materials. Variations in texture, color, grain, chipping at edges, and slight irregularities are natural characteristics of the stone and are not considered defects.

  • Image Representation: We have made every effort to display as accurately as possible the colors and images of our products on monaleah.com. We cannot guarantee that your computer monitor's display of any color will be accurate.

  • Handmade Quality: As our windchimes and ornaments are often hand-assembled or hand-finished, slight variations between the product image and the received item may occur.

4. Refusal of Service (Content Policy)

 While Monaleah honors the memory of all individuals and pets, we reserve the right to refuse to fulfill orders containing content that we, in our sole discretion, deem to be:

  • Unlawful or promoting illegal activity.

  • Hate speech or symbols.

  • Explicitly profane or offensive material that violates the respectful and sentimental nature of our marketplace.

5. Modifications to the Service and Prices

  • Prices for our products are subject to change without notice.

  • We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.

6. Shipping and Production Times

  • Production Time: Please note that "Shipping Time" is different from "Production Time." Personalized items require [1-5] business days to create before they are shipped.

  • Delays: Monaleah is not responsible for carrier delays (UPS, USPS, FedEx) once the package has left our facility.

  • Lost Packages: In the event of a lost package, please contact us so we can assist in filing a claim with the carrier.

7. Returns and Refunds Policy

 Due to the custom nature of our business, our return policy is strict:

  • Personalized Items: All sales are final for personalized goods (items with names, dates, or custom photos). We cannot resell these items; therefore, we cannot accept returns or exchanges for buyer remorse or spelling errors made by the customer.

  • Damaged/Defective Items: If your item arrives broken, damaged, or with an error we caused (e.g., we engraved the wrong date despite you entering the correct one), we will replace the item at no cost to you. You must notify us within 3 days of delivery and provide clear photos of the damage.

8. User-Submitted Content (Photos)

 If you upload photos for printing on ornaments, plaques, or stones:

  • You represent that you own the rights to the image or have permission to use it.

  • You grant Monaleah a license to use the image solely for the purpose of fulfilling your order.

9. Limitation of Liability

In no case shall Monaleah, our directors, officers, employees, affiliates, agents, contractors, or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind arising from your use of any of the service or any products procured using the service.

10. Governing Law

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the State of Pennsylvania.
